1) ZWIZZLE TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Zwizzle mobile application, website, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.

IMPORTANT NOTICE (LIABILITY & SAFETY): Zwizzle is a social platform where you interact with real people. You assume the risks of online and in-person interactions, including meetings, communications, and sharing information. Nothing in these Terms limits any right or remedy you may have that cannot legally be limited or excluded.

1. Who we are (Supplier details)

Zwizzle is operated by:

ZWIZZLE, a private company incorporated in the Republic of South Africa (“Zwizzle”, “we”, “us”, “our”).

2. What documents form the agreement

These documents are incorporated into and form part of your agreement with Zwizzle (together, the “Agreement”):

  • these Terms of Service;

  • the Zwizzle Privacy Policy; and

  • the Zwizzle Community Guidelines.

If there’s a conflict, these Terms prevail unless mandatory law requires otherwise.

3. Eligibility (18+ only)

You may only use Zwizzle if you are 18 years or older and legally able to enter into a binding contract. Zwizzle does not permit minors.

4. Account registration, security, and responsibility

4.1 You must provide accurate information and keep it updated.
4.2 You are responsible for activity on your account and for keeping your login details secure.
4.3 Contact support@zwizzle.co.za immediately if you suspect unauthorised access.
4.4 We may suspend/terminate accounts for safety, fraud prevention, legal compliance, or enforcement of this Agreement.

5. Face verification (biometrics) — consent and limits

5.1 What it is: Zwizzle offers face verification (which may include liveness checks) to reduce fake accounts, improve trust, and protect users.

5.2 Your consent: By using face verification, you consent to Zwizzle processing your verification media (e.g., selfies/videos) and related outputs (including, where applicable, biometric information) for verification, fraud prevention, and platform safety.

5.3 What we show: We may display a verification status (e.g., “verified”) on your profile. We do not promise that verification confirms identity in the real world.

5.4 Service providers: We may use trusted third-party providers (“operators”) to process verification on our behalf under confidentiality and security obligations.

5.5 Retention: We keep verification data only as long as reasonably necessary for verification, safety, fraud prevention, compliance, and dispute handling. You may withdraw consent, but this may limit access to the Service or features.

6. Your content, profile, and communications

6.1 You are responsible for everything you post or send (“User Content”), including photos, videos, bios, messages, and profile details.
6.2 You must have all rights/permissions to upload User Content (including consent from anyone shown).
6.3 Messages and content may be scanned (automatically and/or by humans) to enforce safety, detect abuse, and comply with law.

7. Community Guidelines (safety rules)

You agree to comply with the Zwizzle Community Guidelines. Key prohibitions include (not exhaustive):

  • harassment, hate, threats, stalking, bullying;

  • impersonation, catfishing, scams, extortion, solicitation for money;

  • non-consensual intimate content, sexual exploitation, or anything involving minors;

  • doxxing or sharing private information without consent;

  • bots, scraping, spam, or attempts to bypass security.

We can remove content and restrict or terminate accounts for violations.

8. Your licence to Zwizzle (for operating the Service)

You retain ownership of your User Content. You grant Zwizzle a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (for formatting/safety), display, and make your User Content available only to operate, provide, secure, and improve the Service (including displaying your profile to other users).

9. Safety, meetings, and “no background checks”

9.1 Zwizzle does not conduct criminal background checks or guarantee user identity, intentions, or behaviour.
9.2 You are solely responsible for your interactions with other users (online and offline).
9.3 Use common-sense safety precautions (meet in public, tell a friend, don’t send money, report suspicious behaviour).

10. Free vs Premium; subscriptions; billing; cancellations; refunds

10.1 Free plan: Zwizzle may offer limited features for free.
10.2 Premium plan: Premium provides additional features/benefits as described at purchase. Benefits may change over time to improve the product, prevent abuse, or comply with law, provided changes are not unlawful or misleading.

10.3 Where you buy Premium: Purchases may be processed by:

  • Apple App Store / Google Play (or another platform); and/or

  • a Zwizzle payment provider (if web billing is offered).

10.4 Auto-renewal: Premium subscriptions may auto-renew unless cancelled through the relevant platform settings before renewal.

10.5 Refunds: Fees are generally non-refundable except where:

  • required by mandatory law; or

  • required/allowed by the app store/payment provider’s rules.

10.6 ECTA cooling-off (South Africa): Where applicable to a qualifying electronic transaction, consumers may have rights to cancel within statutory periods. (If your Premium starts immediately with your consent, certain statutory exclusions may apply.)

10.7 Chargebacks and abuse: If you initiate a chargeback without valid grounds, Zwizzle may suspend your account and/or restrict payments, subject to applicable law.

11. Intellectual property

The Service, software, branding, logos, and design are owned by or licensed to Zwizzle. You may not copy, sell, lease, reverse engineer, or exploit the Service except where permitted by law.

12. Termination

12.1 You may stop using Zwizzle at any time and request account deletion via in-app controls (if available) or by contacting support.
12.2 Zwizzle may suspend/terminate if you violate the Agreement, create risk or harm, or where necessary for legal compliance.
12.3 Certain clauses survive termination (e.g., safety enforcement, content licence as needed to operate the Service, limitations, dispute provisions).

13. Disclaimers

The Service is provided “as is” and “as available.” Zwizzle does not guarantee matches, compatibility, responses, relationships, or uninterrupted service.

14. Limitation of liability; indemnity

14.1 Limits apply only to the maximum extent permitted by law. Nothing excludes liability that cannot legally be excluded (including for intentional misconduct, and other non-excludable consumer protections).

14.2 No indirect damages: Zwizzle is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or interactions with other users.

14.3 Liability cap: To the extent liability can be limited, Zwizzle’s total aggregate liability relating to the Service will not exceed the greater of:

  • the total amount you paid Zwizzle in the 3 months before the event giving rise to the claim; or

  • ZAR 1,000.

14.4 Indemnity: You agree to indemnify Zwizzle for losses, claims, and expenses arising from your breach, your User Content, unlawful conduct, or violation of third-party rights, to the extent permitted by law.

15.4 Zwizzle chooses the above physical address as its domicilium citandi et executandi for service of legal process.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Courts in South Africa will have jurisdiction, unless mandatory consumer laws in your country require otherwise.

17. Changes to the Agreement

We may update these Terms, the Privacy Policy, or the Community Guidelines. Material changes will be notified in-app or by email where reasonably possible. Continued use after the effective date means you accept the updated version.


2) ZWIZZLE PRIVACY POLICY (POPIA)

This Privacy Policy explains how Zwizzle collects, uses, shares, and protects personal information.

We may collect:

  • Account info: phone/email, login identifiers, age confirmation, verification status.

  • Profile info: photos/videos, bio, preferences, interests, languages, location (if enabled).

  • Messages & interactions: chats, likes, matches, blocks, reports.

  • Verification info: selfie/photo/video submitted for face verification, and outputs/results (including where applicable biometric information).

  • Device/technical info: device identifiers, IP address, logs, analytics, crash reports.

  • Payments: subscription status and transaction confirmations (typically from app stores/payment providers).

3. Special personal information (including biometrics)

Dating services can involve special personal information (e.g., sex life/sexual orientation) and biometric information during face verification. We process such information only where lawful and with appropriate safeguards, including consent and security.

4. Purposes (why we use it)

We use personal information to:

  • provide the Service (matching, messaging, account management);

  • improve features and performance;

  • enforce safety rules and prevent fraud/scams;

  • conduct face verification and reduce fake accounts;

  • handle support and complaints;

  • communicate service notices; and

  • comply with legal obligations.

5. Sharing

We may share personal information with:

  • other users (your profile and what you choose to share);

  • operators/service providers (hosting, analytics, moderation, verification, support tools) under contractual confidentiality/security;

  • payment platforms (Apple/Google/payment gateways) for subscriptions and billing;

  • law enforcement/regulators where required or to prevent serious harm; and

  • parties involved in a business transfer (sale/merger), with appropriate safeguards.

We do not sell personal information as a business model.

6. International transfers

Your data may be processed outside South Africa depending on where our providers operate. We use reasonable safeguards to protect information for cross-border processing.

7. Security and breach notification

We use reasonable technical and organisational security measures. If a security compromise occurs, we will notify affected users and the regulator where required by law.

8. Retention

We keep information only as long as necessary for the purposes above, including safety, dispute handling, and legal compliance. Some limited data (e.g., fraud signals, reports, logs) may be retained after deletion to prevent abuse and protect users.

9. Your rights

Subject to applicable law and verification, you may request:

  • access, correction, or deletion of your personal information;

  • withdrawal of consent (which may restrict features or require account closure); and/or

  • objection to certain processing.

3) ZWIZZLE COMMUNITY GUIDELINES

Effective date: 13 January 2026
Zwizzle is built for respectful, safe connections. These Guidelines are part of the Agreement. If you break them, we may remove content, restrict features, suspend, or permanently ban your account.

1. Zero tolerance

  • Minors (under 18): not allowed — immediate ban.

  • Sexual exploitation / non-consensual intimate content / sextortion: immediate ban and may be reported.

  • Threats of violence, stalking, hate, harassment: immediate action.

2. Be real

  • No impersonation, catfishing, fake accounts, or misleading age/identity.

  • Don’t upload photos that aren’t you (unless clearly allowed and not misleading).

3. No scams or solicitation

  • No asking for money, gift cards, crypto, bank details, or “emergency” help.

  • No recruitment for schemes, escorting, or paid sexual services.

4. Respect privacy

  • Don’t share someone else’s phone number, address, workplace, IDs, or private images without consent.

  • Don’t threaten to expose someone’s info (“doxxing”).

5. Appropriate content

  • No illegal content.

  • No hateful or degrading content.

  • Keep nudity/explicit sexual content off public profiles (and never share anything non-consensual).

6. No spam or automation

  • No bots, scraping, bulk messaging, or attempts to bypass limits or security.
